GENERAL TERMS AND CONDITIONS (GTC)

applicable to the online store yourdailyjewellery.eu

1. INTRODUCTORY PROVISIONS AND DEFINITIONS

1.1. These General Terms and Conditions (hereinafter referred to as “GTC”) govern the rights and obligations of the contracting parties arising from the purchase agreement concluded remotely through the online store www.yourdailyjewellery.eu.

1.3. Buyer: A natural person (Consumer) who, when concluding and fulfilling a consumer contract, does not act within the scope of their business activity, employment, or profession.

1.4. By submitting the order, the Buyer confirms that they have familiarized themselves with these GTC, of which the Complaints Policy and Privacy Policy are an integral part, and that they agree with them.

2. CONCLUSION OF THE PURCHASE AGREEMENT

2.1. The presentation of goods on the website is for informational purposes only and does not constitute a binding offer to conclude a contract.

2.2. The purchase agreement is concluded at the moment of order confirmation by the Seller. The confirmation is sent to the Buyer by email after the order is placed.

2.3. The Buyer adds goods to the shopping cart, fills in billing and shipping details, and selects the shipping and payment method. Before final submission, they have the option to review and change the entered data.

2.4. The Seller reserves the right to cancel the order (withdraw from the contract) before delivery of the goods if the goods are sold out, the supplier’s price has significantly changed, or in case of an obvious error in the price of the goods in the e-shop (e.g., a gold ring for €0).

3. PRICE OF GOODS AND PAYMENT TERMS

3.1. All prices listed in the online store are final, including VAT (23%) and all other taxes and fees. The price does not include shipping costs, which are shown in the cart.

3.2. The Buyer can pay for the goods using the following methods:

Online Payments

Online payments are processed by the Comgate payment gateway. The service provider, Comgate a.s., is a licensed Payment Institution operating under the supervision of the Czech National Bank. Payments made through the payment gateway are fully secured, and all information is encrypted. For more information and contacts, visit www.comgate.cz.

Card payment is the most frequently used payment method. The Comgate payment gateway supports Visa, Visa Electron, Mastercard, and Maestro cards, as well as Apple Pay and Google Pay, where customers pay with a card stored in their Apple/Google Wallet.

Online Bank Transfer

Goods are dispatched only after the full purchase price has been credited to the Seller’s account.

Payment Process

  1. The customer selects their bank from the list of banks.
  2. After selecting the bank, the customer can pay via QR code or click “Pay via online banking” and will be redirected to their online banking.
  3. After logging into online banking, a pre-filled payment order will be displayed. In this order, the customer cannot change the amount, variable symbol, or the recipient’s bank.
  4. After payment, the customer will be redirected back to the e-shop.

Cash on delivery

Cash or card payment directly to the courier or at the pick-up point upon receipt of goods. (only in certain countries)

4. DELIVERY TERMS AND SHIPPING METHOD

4.1. The Seller is obliged to deliver the goods within 30 days; however, the usual dispatch time is 2 – 5 business days (if the goods are in stock).

4.2. The buyer has the following shipping options:

  • GLS Courier Service (to address): Delivery directly to the address specified in the order.

4.3. Shipping Cost:

  • GLS: €6
  • For orders over €60, shipping is FREE.

4.4. The Buyer is obliged to inspect the goods upon receipt. If the packaging is visibly damaged, we recommend not accepting the shipment or drawing up a Damage Report with the carrier. Later claims for mechanical damage caused by transport may not be recognized.

5. RETENTION OF TITLE

5.1. The goods remain the property of the Seller until full payment of the purchase price and receipt of the goods by the Buyer.

6. WITHDRAWAL FROM THE CONTRACT AND RETURN OF GOODS

6.1. The Buyer has the right to withdraw from the purchase agreement without stating a reason within the statutory period of 14 calendar days from the day of receipt of the goods.

6.2. Return Procedure: * The buyer must pack the goods to prevent damage during transport (we recommend using a sturdy box, not just an envelope). * Send the goods to the address: 585 group s.r.o., Vodná 5, 949 01 Nitra. * Cash on delivery shipments will not be accepted.

6.3. Condition of Returned Goods: Goods must be returned complete, undamaged, clean, and, if possible, in their original packaging. * If the goods were fitted with a security seal or tag, its removal is considered use of the goods beyond what is necessary to ascertain their properties, and the Seller has the right to compensation for damages (reduction of the refunded amount).

6.4. Inability to Withdraw (Personalized Goods): In accordance with § 7 para. 6 of Act No. 102/2014 Coll., the Buyer cannot withdraw from the contract if the goods are manufactured according to the consumer’s specific requirements (e.g., custom engraved wedding rings, personalized jewelry, custom size adjustments).

7. COMPLAINTS POLICY AND WARRANTY

7.1. All goods sold are covered by a statutory warranty period of 24 months.

7.2. The warranty covers manufacturing defects in material and workmanship (e.g., alloy defects, stone falling out due to faulty setting).

7.3. The warranty DOES NOT COVER:

  • Normal wear and tear caused by use (e.g., minor surface scratches, rhodium plating wear, loss of luster).
  • Mechanical damage caused by the Buyer:
    • Chain breakage: A chain is delicate jewelry that cannot withstand strong pulling. Breakage is not a manufacturing defect.
    • Ring deformation due to pressure (e.g., when carrying heavy bags).
    • Stone or glass breakage due to impact.
  • Damage caused by chemical influences (perfume, hairspray, chlorine in the pool, thermal water, cleaning agents).
  • Oxidation (tarnishing) of silver: This is a natural physicochemical property of silver when in contact with air or aggressive perspiration. It is not a material defect, but a condition that can be removed by cleaning.

7.4. Claim Procedure: The claimed goods must be sent to the registered office address: 585 group s.r.o., Vodná 5, 949 01 Nitra. Please attach a description of the defect and proof of purchase to the goods. The Seller will decide on the claim immediately, in complex cases within 3 days, but no later than 30 days from the date of filing.

8. HALLMARKS AND INSPECTION

8.1. 585 group s.r.o. is registered with the Assay Office of the Slovak Republic.

8.2. Goods sold made of gold alloys (over 0.5 g) and silver alloys (over 2.0 g) are properly hallmarked in accordance with the Assay Act.

8.3. The goods bear the following marks:

  • Fineness Mark: A number indicating the fineness of the metal (e.g., 585 for 14k gold, 925 for silver).
  • Responsibility Mark: A mark of the importer or manufacturer assigned by the Assay Office.
  • State Hallmark: Stamped by the Assay Office of the SR (for goods exceeding the specified weight). 8.4. An illustration of valid hallmarks can be found on the e-shop’s website in the section “About Shopping” or on the website of the Assay Office of the SR.

9. DISPUTE RESOLUTION AND ALTERNATIVE DISPUTE RESOLUTION (ADR)

9.1. If the Buyer is not satisfied with the handling of a complaint or believes that their rights have been violated, they have the right to contact the Seller with a request for redress.

9.2. If the Seller responds negatively to the request or does not respond within 30 days, the Buyer has the right to submit a proposal for initiating alternative dispute resolution to an ADR entity (e.g., Slovak Trade Inspection) or through the ODR platform (http://ec.europa.eu/consumers/odr).

10. PRIVACY POLICY (GDPR)

10.1. The Seller processes the Buyer’s personal data to the extent necessary for the performance of the contract (name, address, phone, email). This data is not provided to third parties, with the exception of contractual partners providing transport (Packeta, courier service) and accounting services.

11. FINAL PROVISIONS

11.1. These GTC become valid and effective on the date of their publication on the website.

11.2. The Seller reserves the right to change the GTC. The obligation to provide written notification of changes is fulfilled by their placement on the store’s website.

11.3. Legal relations not regulated by these GTC are governed by the relevant provisions of the Civil Code, the Consumer Protection Act, and the Electronic Commerce Act valid in the Slovak Republic.
